How to Appeal a Rejected UIF Claim

How to Appeal a Rejected UIF Claim

You can appeal the rejection of your UIF claim by sending the UI-12 form to your local Department of labour. This form consists of information from your employer stating the reasons for termination of employment. You must also attach proof or any other documentation that reinforces your reasons for appealing.  

Rejection of the UIF claim can be caused by the submission of incorrect information by the claimants. For instance, if your banking details are incorrect, your application will be rejected. If you are a maternity beneficiary and you fail to claim UIF within six months of pregnancy, you will not get benefits at a later stage.

Ensure you appeal the non-payment of benefits decision within 90 days at the Regional Appeals Committee. If you are unhappy about the decision made by the Regional Appeals Committee, you can take the matter to the National Appeals Committee, whose decision is final. Again, if you are unhappy about the final decision, the only remedy left is going to court. 

How Long Does a UIF Appeal Take?

You must lodge your appeal in writing within 90 days of receiving the rejection notice of your claim. The UIF will respond to your appeal within 72 hours, but they first conduct a verification exercise to determine the validity of your claim. For example, UIF conducts bank verification via phone. They can reach out to your employer and ask pertinent questions that can help them make a decision. 

The UIF will also call to verify your details by asking you five security questions. They will also request you provide your latest confirmation letter from the bank, which must not be older than three months. You will be asked to verify your CIPC number, banking details, ID number, and trade name as compared to the information on the UIF database. What Happens After UIF Notice of Appeal Approved?

UIF usually decides to accept or decline your appeal within five working days. If the notice of appeal is approved, you will get a notification via email. You will have 72 two hours to respond to the decision and take appropriate measures to get your UIF benefits. Be sure to respond within the stipulated time. 

Can I Appeal UIF Online?

You cannot appeal the UIF online because the process requires you to send the UI-12 form to your local Department of labour. This form is available on the UIF website, and your employer must download it and then fill in the necessary details.   

What Does It Mean When Your UIF Claim Is Rejected?

For instance, if your application is incomplete or other sections have incorrect information, your application will be declined. 

To prevent fraud, UIF verifies all the applications to ensure that only registered members who have been contributing to the fund get the benefits. If you provide incorrect employment records, you will not get any payment. 

In some cases, the rejection of claims is caused by employers who do not register their employees. Some employees may assume that they are registered for UIF, but this is not always the case. To prevent such a situation, it is recommended that you register for uFiling and create your account, which you can use to check your UIF status

Your employer might not be contributing monthly payments to the fund, and this will lead to the denial of your claim. If you realize they your employer is not submitting your monthly contribution to SARS, you can report them to UIF. The benefits you will get from UIF come from the money which you contribute to the fund. UIF benefits are different from other government grants, which can be paid to needy members of society. 

If you return to work and fail to notify UIF, your application will be regarded as fraudulent. Any suspicion of making a false claim will lead to the rejection of your claim. If your salary is based on commissions, you cannot be registered for UIF. Therefore, you cannot claim benefits that you are not part of. 

If you resign or abscond from work, you will be disqualified from getting UIF benefits. You can only qualify if you can prove an acceptable dismissal case. Benefits are meant for employees who lose their jobs involuntarily. 

You should apply for UIF within an acceptable time frame after losing your job. For example, your UIF claim will be rejected if you submit it twelve months after the termination of your job. You must apply for benefits within 12 months of becoming unemployed. The same applies to the claim of maternity benefits. You cannot claim the birth of your child. If you have less than 13 weeks in your job, you cannot claim UIF maternity benefits. 

The unemployment insurance fund is a government program that is meant to provide financial employees to registered members who are no longer able to work due to various reasons. Although you might be contributing to the fund, your application for UIF benefits can be declined as a result of different reasons. If your claim is rejected, you can appeal the decision by sending the UI-12 form to your local Department of labour. Make sure you double-check your details to improve your chances of getting approved.
